1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and Zenedge Consulting, registered in the Netherlands, operating as WhatsScale.

By accessing or using WhatsScale, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the service.

2. Service Description

WhatsScale is a WhatsApp automation platform that allows users to:

  • Send WhatsApp messages programmatically via API
  • Schedule messages for future delivery
  • Send text, images, and videos to contacts and groups
  • Post to WhatsApp Status
  • Integrate with third-party services via Zapier
  • View message analytics and history

WhatsScale is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta Platforms, Inc.

3. Account Registration

To use WhatsScale, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Have a valid WhatsApp account on a phone you own or control
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use Policy

You agree to use WhatsScale in compliance with all applicable laws and regulations. You must NOT use WhatsScale to:

  • Send spam, unsolicited messages, or bulk promotional content
  • Harass, threaten, or abuse any individual or group
  • Distribute malware, phishing attempts, or fraudulent content
  • Send illegal content or promote illegal activities
  • Impersonate others or misrepresent your identity
  • Violate intellectual property rights of others
  • Collect personal data without proper consent
  • Interfere with or disrupt the service
  • Attempt to bypass security measures or rate limits

Important: You must comply with WhatsApp Terms of Service at all times. You are solely responsible for obtaining proper consent from recipients before sending them messages. Violation may result in immediate account termination.

5. API Usage

When using the WhatsScale API, you agree to:

  • Keep your API key confidential and secure
  • Not share your API key with unauthorized parties
  • Use the API in accordance with our documentation
  • Respect rate limits and fair usage guidelines
  • Regenerate your API key immediately if compromised

We reserve the right to throttle or suspend API access for accounts that abuse the service or negatively impact system performance.

6. Intellectual Property

The WhatsScale platform, including its design, code, features, and documentation, is owned by Zenedge Consulting and protected by intellectual property laws.

You retain ownership of all content you send through WhatsScale. By using our service, you grant us a limited license to process your content solely for the purpose of providing the service.

7. Payment Terms

WhatsScale is currently free during our beta period. When paid plans are introduced:

  • Pricing will be clearly communicated before charges apply
  • Beta users will receive advance notice and special pricing
  • Payments will be processed securely through our payment provider
  • Refunds will be handled according to our refund policy

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. WhatsScale may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or security updates
  • Factors beyond our control (internet outages, third-party services)
  • Changes to WhatsApp policies or platform

9. Limitation of Liability

To the maximum extent permitted by law, Zenedge Consulting shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Actions taken by WhatsApp against your account
  • Content sent by you through the platform
  • Service interruptions or data loss

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

10. Disclaimer

WhatsScale is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, secure, or uninterrupted. We are not responsible for any actions WhatsApp may take against your account as a result of using automation tools.

11. Termination

We may suspend or terminate your account immediately if you:

  • Violate these Terms of Service
  • Violate WhatsApp Terms of Service
  • Engage in fraudulent or illegal activity
  • Abuse the platform or other users

You may terminate your account at any time by contacting support. Upon termination, your right to use the service ceases immediately, and your data will be deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or your use of WhatsScale shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through a notice on our website at least 30 days before changes take effect. Your continued use of WhatsScale after changes are posted constitutes acceptance of the updated Terms.
